Understanding INS Fiance Visa

The INS (Immigration and Naturalization Service) is now changed to USCIS (U.S. Citizenship and Immigration Services) and comes within the Department of Homeland Security.

Once the INS fiance Visa form is submitted, the INS takes 120 days to process the petition. If the documentation is complete, the processing becomes relatively speedy. The immigration fiance visa is also known as the K1 fiance visa. This is a Visa helps to bring foreign citizens to the U.S. because they intend to marry a U.S. citizen.

The Immigration fiance visa or the INS fiancee visa helped those who faced many problems in applying for the spousal visa. This is when the fiance visas did not exist. People could only apply for the spousal visa in which the U.S. citizen married in another country, the country to which the fiance belonged, and only then it was possible to apply for the spousal visa.

Historically the fiance visa application process has been a lengthy one. To solve this problem, the immigration issues of INS were streamlined. The INS fiancee visa was introduced. This helped the foreign citizen to migrate from another country and enter the U.S. with the sole intention to marry the U.S. citizen. This is therefore also referred to as the immigration fiance visa process.

The process gives the foreign citizen a period of 90 days to get married. This gives the foreign citizen sufficient time to adjust to the new environment and experience how life would be after marriage. This facility was not given to those who applied for the spousal visa.

The work of the U.S. INS which now ceases to exist is now performed by the USCIS. The INS thus prevented the illegal entry to the U.S. and enforced laws of naturalization. Through these laws, it was established as to how the foreign citizens can become citizens of the U.S.

The people applying for the fiance visa have to submit their petition to the USCIS. The USCIS is under the jurisdiction of the Department of Justice. The function of the USCIS is to promote national security, eliminate immigration case backlogs and improve efficiency of customer services.

All the processing of the INS is now handled by the USCIS - the INS is now defunct. Thus, the INS forms too were affected. Currently, the USCIS handles forms of two types, one that relate to immigration and the other that relate to naturalization.

With the introduction of the INS, the severe immigration laws were made a little less severe. The laws enforced by the immigration INS gives sufficient scope to the foreign citizen to migrate to the U.S. and become immigrant citizens. It also provided sufficient national security. It provides a visa to the foreign citizens and helps them enjoy their rights as citizens.

The INS fiance visa streamlines entry into the US through the institution of marriage. Once the marriage takes place, it is possible to become a permanent citizen by applying for the green card through marriage.
